Burke Electrical PowerGuard Membership Terms of Service
These terms apply to Burke Electrical membership customers in Idaho. Please review them before enrolling in a plan.
1. Scope of Services
PowerGuard Memberships include periodic inspections, minor service work, and priority scheduling based on the selected plan tier.
Services are limited to residential electrical systems unless otherwise agreed in writing.
All work will comply with applicable Idaho electrical codes and local jurisdiction requirements.
PowerGuard Memberships are preventative in nature and do not guarantee identification of all defects, concealed issues, or future failures.
2. Licensing & Compliance
All work is performed by or under the supervision of licensed electricians in accordance with Idaho state requirements.
3. Scheduling & Access
Membership visits are scheduled with reasonable notice.
The customer must provide safe and unobstructed access to panels, outlets, wiring, equipment, and other electrical systems that need to be inspected or serviced.
Missed appointments, unsafe conditions, or lack of access may result in rescheduling.
4. Included Repairs & Service Calls
Included service calls cover minor electrical repairs only, based on the selected membership tier.
Major installations, upgrades, replacements, remodel work, panel upgrades, new circuits, or other larger projects are excluded unless otherwise agreed in writing.
Any additional work outside the plan requires customer approval before work begins.
5. Priority Service
Priority service means Burke Electrical will make reasonable efforts to schedule membership members ahead of non-plan customers when possible.
Priority service is not guaranteed and depends on availability, weather, emergency conditions, staffing, parts availability, and other circumstances outside Burke Electrical’s control.
6. Billing & Payments
PowerGuard Memberships are billed monthly and payment is due at the time of billing.
Accounts more than 10 days past due may be suspended until the account is brought current.
7. Term & Cancellation
PowerGuard Memberships are month-to-month agreements unless otherwise stated in writing.
Customers may cancel before the next billing cycle.
No refunds are provided for partial billing periods.
8. Discounts & Exclusions
Any plan discount applies to labor only unless otherwise stated in writing.
Discounts do not apply to materials, permits, third-party services, specialty equipment, or work outside the memberships scope.
9. Customer Responsibilities
The customer is responsible for providing safe working conditions, disclosing known electrical issues, and maintaining compliance with applicable property, safety, and access requirements.
Customers should notify Burke Electrical of any known hazards, prior work, unpermitted modifications, water damage, fire damage, pest damage, or other conditions that may affect the electrical system.
10. Limitation of Liability
Burke Electrical is not liable for pre-existing conditions, concealed defects, improper prior work, unpermitted modifications, inaccessible systems, or issues that could not reasonably be identified during preventative maintenance.
To the fullest extent allowed by law, Burke Electrical’s liability is limited to the payments made by the customer under the maintenance plan during the prior 12 months.
11. No Warranty
PowerGuard Memberships provide preventative service only.
Burke Electrical does not guarantee that electrical systems will not fail, that all issues will be identified, or that future repairs will not be needed.
12. Consumer Protection
These terms are intended to comply with applicable Idaho law and consumer protection requirements.
13. Indemnification
The customer is responsible for unsafe conditions, undisclosed hazards, unauthorized modifications, or conditions caused by others that affect Burke Electrical’s ability to safely perform work.
14. Mechanics Lien Rights
Burke Electrical reserves all rights available under Idaho law, including applicable mechanics lien rights for unpaid labor, materials, or services.
15. Governing Law & Venue
These terms are governed by the laws of the State of Idaho.
Venue for any dispute shall be in the county or jurisdiction where the service is performed, unless otherwise required by law.
16. Changes to Terms
Burke Electrical may update these terms from time to time.
Continued participation in a maintenance plan after updated terms are posted or provided means the customer accepts the updated terms.
